1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Nota Mérican, a geography quiz game and related services available at nota.uno and via our iOS/Android apps (the "Service"), operated by Data212 Inc. ("Data212," "we," "us," or "our"), a corporation incorporated in Ontario, Canada.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. By using the Service, you represent that you meet this requirement.
3. Accounts
3.1 Account Creation
You may use parts of the Service as a guest, including playing quizzes and purchasing Pro through the App Store or Google Play (no Nota account required for those purchases). Creating an account is optional and enables syncing progress and entitlements across devices, leaderboards, and account recovery.
3.2 Account Security
You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at privacy@nota.uno if you suspect unauthorized access.
3.3 Username and Profile
Usernames must be 3-20 characters, alphanumeric and underscores only. We reserve the right to reclaim or modify usernames that infringe trademarks, impersonate others, or violate community standards.
4. Subscriptions and Payments
4.1 Tiers
The Service offers a free tier and a paid Pro subscription. Features and pricing may change; current details are shown in the app or at nota.uno/pricing.
4.2 Platform billing
- Website: payments are processed by Stripe. Subscriptions auto-renew until cancelled in your account dashboard.
- iOS app: payments are processed by Apple as in-app purchases (via RevenueCat). Manage or cancel in iOS Settings → Apple ID → Subscriptions. Apple’s terms apply to those purchases.
- Android app: payments are processed by Google Play (via RevenueCat). Manage or cancel in Google Play subscriptions.
A Pro entitlement purchased on one platform may unlock Pro in the Service across platforms when linked to the same account (or after you optionally sign in and restore), subject to store rules and our entitlement sync.
4.3 Free Trials
We may offer free trials. Trials may convert to paid subscriptions unless you cancel before the trial ends, subject to the store or Stripe rules shown at checkout.
4.4 Cancellation
- Web (Stripe): cancel anytime from your account; access continues until the end of the paid period.
- App Store / Play: cancel through the store’s subscription management UI.
4.5 Refunds
Refunds for web purchases are handled per our policy and applicable law (contact privacy@nota.uno). Refunds for App Store or Google Play purchases are handled by Apple or Google under their refund policies.
4.6 Restore purchases (apps)
If you reinstall the app or switch devices, use Restore purchases in Settings (or on the paywall) to re-link an existing App Store / Play subscription to your account.
4.7 Price Changes
We may change subscription prices with notice as required by law and by Apple/Google/Stripe. Changes apply to future billing periods.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to circumvent paywalls, hearts/permits limits, or other access controls
- Use bots, scrapers, or automated tools to access the Service without our written permission
- Cheat or manipulate scores, leaderboards, or achievements
- Reverse engineer, decompile, or extract source code from the Service
- Resell or sublicense the Service without our written permission
- Upload or transmit malware, harmful code, or content that violates intellectual property rights
- Harass, abuse, or impersonate others
- Submit false or misleading information
We reserve the right to suspend or terminate accounts that violate these rules.
6. Intellectual Property
6.1 Our Content
The Service, including its visual design, code, brand assets, mascots, quiz content, and game mechanics, is owned by Data212 Inc. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
6.2 User-Generated Content
If you submit content (e.g., usernames, feedback), you grant us a worldwide, royalty-free license to use, display, and modify that content as necessary to operate the Service.
6.3 Third-Party Content
Flag images, country data, and other geographic content may be derived from public-domain or third-party sources. Trademarks and country symbols belong to their respective owners; their use here is for educational purposes.
7. Privacy
Your use of the Service is also governed by our Privacy Policy.
8. Third-Party Services
The Service integrates with third-party providers including Apple, Google, Stripe, RevenueCat, Vercel, Supabase, and (on the website) analytics providers such as Google and Microsoft. Their terms and privacy policies apply to your use of those services.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Quiz content is for entertainment and education and may contain errors.
10. Limitation of Liability
To the fullest extent permitted by law, Data212 Inc. and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.
11. Indemnification
You agree to indemnify and hold harmless Data212 Inc. from any claim, loss, or expense (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may close your account in Settings or by contacting privacy@nota.uno.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email (where applicable) or via a notice on nota.uno. Continued use after the effective date constitutes acceptance.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles. Disputes will be resolved in the courts located in Toronto, Ontario, Canada, except where mandatory consumer protections require otherwise. App Store purchases may also be subject to Apple’s dispute processes.
15. Miscellaneous
- Severability: If any provision is held invalid, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any provision is not a waiver.
- Assignment: You may not assign these Terms without our consent.
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement regarding the Service.
